Shari'ah Compliant Wills:
In the Islamic context, the distributions are not at the discretion of the individual; rather, they are dictated in detail in the Qur’an and Hadith. Therefore, under Shariah law every individual’s estate would automatically be distributed in accordance with the rules outlined in the Qur’an and Hadith.
A carefully drafted Islamic will is most likely to be given full force and effect in The United Kingdom, so long as it complies with the various statutory requirements of a properly drafted will. Despite the large disparity between English Law and Shariah inheritance laws, the courts of England and Wales give an individual the freedom to carry out his or her intentions after death. As a result, Muslims in England and Wales have the freedom to fulfill their obligations under Shari'ah law in the distribution of their property after their death so long as they ensure they are in compliance with the laws of their jurisdiction, a step that is easily carried out with the assistance of Regal Law Solicitors.
